The Court of Appeal decision of 25 October 2024 on the topic of broker commissions in the motor finance sector had created significant legal and commercial uncertainties and had had an immediate impact on many lenders and brokers in the sector, with market practice on the disclosure of commission having evolved rapidly. In this webinar, we examined the Supreme Court decision to identify how the court had addressed the challenges posed by the Court of Appeal decision. In particular, we covered what the court had decided on fiduciary and disinterested duties; remedies; the impact on lenders and brokers, and related financing structures; the implications for brokered arrangements in other areas of financial services; and next steps for the FCA, including the potential redress scheme.
