On 7 August 2023 the Financial Conduct Authority published its consultation on new securitisation rules. The FCA's consultation needs to be read together with the equivalent Prudential Regulation Authority consultation and the UK Government's near-final statutory instrument and policy note. When finalised, these will together replace the UK Securitisation Regulation, which is currently retained EU law.
In this briefing, we consider the main elements of the consultation and next steps in the UK Government's "Smarter Regulatory Framework" project as it applies to securitisation.
